By accessing and using www.thaifruitpowders.com (the "Website"), operated by Thai Freshmax Limited Partnership ("Thai Freshmax", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). This Website is intended for B2B business inquiries, Request for Quotation (RFQ) submissions, sample requests, and export ordering of natural fruit and herb powders for food manufacturing. If you do not agree to these Terms, please do not use the Website. We reserve the right to update these Terms at any time with notice on the Website.

We manufacture 100% natural spray-dried fruit and herb powders including Lime Powder, Mango Powder, Tom Yum Powder, Kaffir Lime Powder, Mangosteen Powder, Coconut Powder, Tamarind Powder, Lemongrass Powder, Ginger Powder, and custom blends. Product Specifications: 100% Natural, No Additives, No Preservatives, No Artificial Colors, Moisture Content <5%, Water Activity <0.6, Shelf Life 24 Months from Manufacture Date when stored in cool dry place <25°C, Packaging Standard 10kg Aluminium Foil Bag with PE Liner + Outer Carton Box, or Retail Sachet 10g-1kg for OEM. Certificate of Analysis (COA) provided per lot, including microbiological, moisture, and heavy metals. Product descriptions, images, and specifications are subject to change without notice for quality improvement. Products are intended for food manufacturing, beverage, seasoning, bakery, and industrial use, not for direct medical claims.

Minimum Order Quantity (MOQ): 200kg per SKU for standard products, 300-500kg per SKU for OEM / Private Label custom formulation. Pricing: Quoted in USD FOB Bangkok Port (Laem Chabang) or FOB Suvarnabhumi Airport (BKK), validity 15 days from quotation date. Pricing excludes customs duties, import taxes, VAT, and destination country compliance costs. Payment Terms: T/T (Telegraphic Transfer) 30% deposit upon Proforma Invoice confirmation and 70% before shipment against shipping documents, or L/C at Sight (Letter of Credit) for orders over $10,000 USD via reputable bank, accepted after bank confirmation. Samples: 50g free per SKU (max 3 SKUs per company), freight collect via DHL/FedEx account or buyer pays courier cost approximately $30-50 USD. Proforma Invoice issued after RFQ details confirmation including product, quantity, packaging, destination port. All payments to Thai Freshmax Limited Partnership bank account in Thailand.

Shipping Terms: FOB Bangkok Port (Laem Chabang) or FOB Suvarnabhumi Airport (BKK) per Incoterms 2020. Lead Time: 7-15 business days after deposit receipt and artwork approval for OEM, plus shipping transit time (Air 3-5 days, Sea 15-30 days depending on destination). Factory Location Advantage: Located 45 minutes from Bangkok Port and Suvarnabhumi Airport for efficient logistics and reduced inland freight. Buyer Responsible: Import customs duties, taxes, FDA Prior Notice (USA), EU TRACES, Japan Food Sanitation Law compliance, and local food regulation clearance. We provide Phytosanitary Certificate, Certificate of Origin, Halal Certificate, and commercial invoice for customs. Shipping via DHL, FedEx, or licensed sea freight forwarder with tracking number provided. Risk transfers to buyer upon handover to carrier at FOB point. Delay due to customs, weather, or force majeure not our liability.

All Website content, including but not limited to logos, trademarks, product data, images, specifications, Certificate of Analysis templates, catalog designs, text, graphics, and software, are owned by Thai Freshmax Limited Partnership or licensed to us and are protected by Thai and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content without prior written consent from Thai Freshmax. For OEM / Private Label, buyer trademarks, logos, and packaging designs remain buyer property; buyer warrants that buyer owns or has rights to use such trademarks and indemnifies Thai Freshmax against third-party claims. Unauthorized use may result in legal action under Thai Trademark Act and Copyright Act.

OEM / Private Label Services: Low MOQ 300-500kg per SKU for private label, custom formulation available including fruit blend, seasoning blend, and functional blend. Packaging Options: Bulk 10kg Aluminium Foil Bag with PE Liner + Outer Carton, or Retail Packaging Sachet 10g-1kg, Stand-up Pouch, Jar, with private label design support. Design Support: Multilingual label support English / Japanese / Arabic, artwork approval required before production via email confirmation, 2 rounds of revision included. Buyer Responsibilities: Provide high-resolution logo (AI, EPS, PDF), trademark registration proof, and ensure label compliance with destination country regulations (US FDA Nutrition Facts, EU Food Information, Japan JAS). Confidentiality: Buyer formulas and custom blends kept confidential and not shared with third parties. We reserve right to decline OEM for conflicting brands or trademark infringement concerns.

Quality Management: Manufactured under GMP (Good Manufacturing Practice) certified by Department of Health Thailand, HACCP Certified, Halal Certified by JAKIM Malaysia and CICOT Thailand, FDA Registered Facility for US export. Documents Provided Per Shipment: Certificate of Analysis (COA) including moisture, microbiological (TPC, Yeast & Mold, E.coli, Salmonella), heavy metals, Phytosanitary Certificate from Department of Agriculture Thailand, Halal Certificate, Certificate of Origin, and FDA Prior Notice support for US shipments. Compliance Responsibility: Buyer is responsible for ensuring product compliance with destination country food laws including US FDA 21 CFR, EU Regulation 1169/2011 and Novel Food Regulation, Japan Food Sanitation Act, and local labeling requirements. Quality Claims: Must be filed within 14 days of arrival with photos, lot number, COA discrepancy, and retained sample. We will investigate and, if valid, offer replacement or credit note. No returns for buyer storage mishandling.

Products are intended for food manufacturing, beverage, seasoning, and industrial use as ingredients. Not intended to diagnose, treat, cure, or prevent any disease, and no medical claims are made. Maximum liability of Thai Freshmax for any claim arising from products or Website use is limited to the total amount paid for the specific order giving rise to the claim. We shall not be liable for any consequential, incidental, indirect, special, or punitive damages including loss of profit, loss of business, or loss of goodwill. Buyer is responsible for proper storage in cool dry place below 25°C away from direct sunlight, proper handling per COA and TDS, and final product safety testing. Shelf life 24 months from manufacture date when stored correctly. Force majeure including natural disaster, pandemic, government regulation, or shipping disruption exempts us from liability for delay.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from these Terms or transactions shall first be resolved via good faith negotiation within 30 days via sales@thaifruitpowders.com. If unresolved, dispute shall be submitted to arbitration under Thai Arbitration Institute (TAI) rules, or to the jurisdiction of Samut Prakan Provincial Court, Thailand, as agreed. English language version of these Terms prevails over any translation. Severability: If any provision is held invalid, remaining provisions continue in effect.
